1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and NestureGroup ("we", "us", or "our"). By creating an account, enrolling in courses, purchasing services, or otherwise using our platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility

To use our services, you must:

• Be at least 16 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Not be prohibited from using our services under applicable laws

If you are using our services on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Account Registration & Security

When you create an account with NestureGroup:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorised access or security breach
• You may not share your account with others or create multiple accounts
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Services Overview

NestureGroup operates through three divisions, each with specific terms:

4.1 NestureEducation

Course Access & Enrollment:

• Course access is granted upon successful payment
• Lifetime access applies to purchased courses (unless otherwise stated)
• Course content may be updated or modified without notice
• Certificates are issued upon successful course completion
• Course materials are for personal use only and may not be redistributed

4.2 NestureECom

Agency Services:

• Services are provided according to agreed-upon statements of work
• Payment terms are specified in individual service agreements
• Client must provide necessary access and materials for service delivery
• Results are not guaranteed; we provide best-effort services
• Either party may terminate services with 30 days written notice

4.3 NestureLiving

Lifestyle Services:

• Services are subject to availability and booking confirmation
• Cancellation policies apply as specified at time of booking
• Additional terms may apply to specific lifestyle offerings
• Property access and amenities are subject to rules and regulations

5. Payment Terms

Pricing & Billing:

• All prices are in GBP (£) unless otherwise stated
• Prices are subject to change with notice
• Payment is due at time of purchase or as specified in service agreements
• We accept major credit cards and other payment methods as displayed
• Recurring subscriptions will auto-renew unless cancelled
• You authorise us to charge your payment method for all fees incurred

Taxes:

You are responsible for all applicable taxes. Prices displayed may not include VAT or other taxes, which will be added at checkout where applicable.

6. Refund Policy

NestureEducation Courses

• 14-Day Money-Back Guarantee: Full refund if requested within 14 days of purchase and less than 20% of course content has been accessed
• No refunds after 14 days or if more than 20% of content has been accessed
• Refunds processed within 7–10 business days
• Certificates must be returned for refund eligibility

NestureECom Services

• 90-Day Revenue Guarantee: If we don't increase your revenue within 90 days, we'll work for free until we do (terms apply)
• Refunds for services not yet delivered may be requested
• Completed work is non-refundable
• Specific refund terms outlined in service agreements

NestureLiving Services

• Cancellation policies vary by service and are specified at booking
• Refunds subject to cancellation timeframes
• No-shows are non-refundable

7. Intellectual Property Rights

Our Content:

• All content, materials, and services are owned by NestureGroup or licensed to us
• This includes courses, videos, text, graphics, logos, software, and trademarks
• You may not copy, reproduce, distribute, or create derivative works without permission
• Course materials are licensed for personal, non-commercial use only
• Screenshots, recordings, or sharing of course content is prohibited

Your Content:

• You retain ownership of content you submit (assignments, feedback, etc.)
• You grant us a licence to use your content for service delivery and improvement
• You represent that you have rights to any content you submit
• We may use anonymised student work as case studies or examples

8. Prohibited Conduct

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Share account credentials or course access
• Distribute, sell, or resell our content or services
• Use our services for unauthorised commercial purposes
• Attempt to hack, reverse engineer, or compromise our systems
• Upload malware, viruses, or harmful code
• Harass, abuse, or harm other users or our staff
• Create fake accounts or impersonate others
• Scrape, crawl, or data mine our platforms
• Interfere with the proper functioning of our services
• Use our services to spam or send unsolicited communications

9. Disclaimers & Limitations of Liability

Service Disclaimer

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that services will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of content
• Guarantees of specific results or outcomes

Educational Disclaimer

NestureEducation courses are for educational purposes only. We do not guarantee:

• Employment or income as a result of course completion
• Specific business results or revenue
• That our methods will work for your specific situation

Success depends on individual effort, market conditions, and factors beyond our control.

Limitation of Liability

To the maximum extent permitted by law, NestureGroup shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from unauthorised access to your account
• Damages from errors, omissions, or interruptions in service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NestureGroup, its divisions, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct on our platforms

11. Termination

By You: You may terminate your account at any time by contacting us. Termination does not entitle you to refunds for unused services.

By Us: We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay fees when due
• Abuse our services or staff

Upon termination, your right to access our services ceases immediately. Provisions that should survive termination (payment obligations, intellectual property, disclaimers) will remain in effect.

12. Privacy & Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

13. Third-Party Services

Our services may integrate with or link to third-party services (payment processors, analytics tools, etc.). We are not responsible for:

• The availability or functionality of third-party services
• The content or practices of third-party websites
• Any transactions between you and third parties

Your use of third-party services is subject to their own terms and policies.

14. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at legal@nesturegroup.com to attempt to resolve the dispute informally. We'll work in good faith to reach a resolution within 30 days.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. Arbitration will be conducted in London, UK under the rules of the London Court of International Arbitration (LCIA).

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class-wide arbitration.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any legal action must be brought in the courts of London, United Kingdom.

16. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, pandemics, or acts of God
• War, terrorism, or civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Strikes or labour disputes

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and NestureGroup. They supersede all prior agreements, understandings, and communications.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to any affiliate or successor without restriction.

20. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
